The Court, sitting without a jury, found him guilty, and from the judgment and sentence which followed, he appeals on the formal ground that the evidence was insufficient to sustain the conviction, as a matter of law, relying, however, in substance, on a version of the occurrence different from the States and on the lack of weight of the evidence.
